The jail still exists. There's just no reason to use it.
I'm personally a fan of sending some people to jail and leaving them. I'll even rename the map to Arkham Asylum, first person to find a way to escape and try to kidnap Haine or Tiamat can get a free name change to "The Joker"

What? No, we just mute people now, that's all. We still can send people, and I do occasionally as a joke if I'm in game and people ask (except Kiyle, I used to warp him to the top of ET, but with it open, I have to think of somewhere else).
Also, teg's, if you escape and then manage to give Tiamat or Haine hallucinogenics, then you can be Scarecrow
